Pentagon gives guidance to states to opt out of military voting protections.
The Department of Defense has issued interim guidance to states on how to exempt out of the MOVE Act provisions. The MOVE Act requires states to send ballots to soldiers and sailors at least 45 days before the election. This permits them to fully participate in the election. Prior to the passage of the MOVE Act in 2009, there was no minimum requirement and the Department of Justice considered 30 days to be a minimum time period. Congress strengthened the rights of military voters through the MOVE Act. But it allowed states to apply for a waiver from the provisions.
