DOJ Sues Guam 27 days before election for failing to mail military ballots
As we reported over a week ago, Guam has been ignoring the MOVE Act which requires ballots to go to overseas and military voters at least 45 days in advance of the election. The deadline to mail ballots was September 18. Election Law Center reported that Guam was ignoring the MOVE Act on September 28. Today, October 6, the DOJ has sued Guam.
The lawsuit is a good thing. But it should have come on September 19 at the latest. It has been perfectly clear that Guam was not in compliance with Federal law for the last seventeen days. This is not good news for stalled nominee James Cole. Senator Cornyn might ask why it took seventeen days to file a complaint. Though by now he probably has a pretty good idea why.
In the meantime, it appears Guam has no interest in fixing the problem, but instead awaits a judge's opinion about how to deal with a conflict between Guam law and Federal law.
